── Sexual Abuse

When individuals or entities fail to protect or supervise foster children, allowing the risk of sexual abuse to occur, they may be held liable for the harm caused. This includes those who commit sexual acts against foster children or those responsible for creating conditions that make abuse possible, such as government agencies or corporations. At Kyle J. ── Who Can be Liable for Foster Care Abuse

There are many people, government agencies, and outside contractors who often accept responsibility for the well-being of a foster child. When a foster parent negligently causes harm to a child, the foster parent can be personally responsible, and usually there are one or more liability insurance policies available to defend the foster parent and protect them financially, including foster care liability insurance policies paid for by the department of social services. The South Carolina Department of Social Services or its employees may also be liable, and a judgment against DSS or its employees will be satisfied by the South Carolina Insurance Reserve Fund. Often, DSS will outsource various licensing, training, and supervisory functions to outside contractors, which may be liable in the event of foster care abuse. Those outside contractors and their employees may also be liable for the harm caused by foster care abuse. Or sometimes law enforcement may be liable for failure to protect a foster child from foster care abuse.
